As an experienced lawyer with nearly a decade of practical experience in reviewing and drafting business contracts and other agreements, I created this template restaurant lease agreement to assist restaurant owners in entering into a lease with the owner of a commercial rental property. Overview of the Template Restaurant Lease Agreement
My template restaurant lease agreement outlines the rights and obligations of both the landlord and tenant when the landlord rents out commercial property. Either party can be an individual or company. A tenant can also be referred to as a renter or lessee.
The agreement can help set forth the lease terms so both parties are bound to them. It also provides the tenant the right to use the rental property for business purposes - for this particular template, in the capacity of a restaurant offering food services - during the term of the lease in exchange for payment to the landlord.
What is Included in the Template Restaurant Lease Agreement?
My template restaurant lease agreement contains important provisions such as details of the property to be leased (including as the address and legal description of the commercial rental space) and the details of both the restaurant tenant and landlord. My template also contains a section describing the permitted use of the rental property and any restrictions placed upon the landlord (e.g., agreeing not to lease to direct competitors in the same space or building).
My template restaurant agreement contains provisions that set forth the lease terms (e.g., lease type, lease term, whether or not the tenant can assign or sublease the property), along with the amount of rent, and payment frequency. My template also addresses which party is responsible for utilities, insurance payments, the payment of a security deposit, and any common area expenses. In addition, there are provisions addressing reimbursement for attorney’s fees, in the event of litigation, entry rights, inspection rights, and a requirement to comply with all statutes, ordinances, regulations, covenants, conditions and requirements of all municipal, state and federal authorities (including owner’s association and similar entities) now in force, or which may hereafter be in force, pertaining to the leased property.
