Purchase and sale agreement and inspections?
I am in the process of buying a home, and I recently received a Purchase and Sale Agreement from the seller. I'm concerned about the inspection contingency in the agreement, because I'm not sure if it protects me as a buyer if there are any issues with the home. I want to make sure my interests are fully protected in the agreement, so I'm looking for legal advice on how to properly interpret and negotiate the inspection contingency.

It is recommended that you seek the assistance of an attorney before signing any contract. In addition, it is recommended that you sign an as-is contract, because the inspection period provides you the opportunity to terminate the contract for any reason, if you are not satisfied with the results of the inspection. But you must terminate within a timely period as set forth in the contract.

I am on a deed with my brother. He took a loan out on the home and fallen behind on payments. What can I do to protect my half of the deed and keep from losing our home.

A joint owner of real estate can generally encumber the property, such as by mortgaging their interest, without permission of the other joint owner. If your brother falls behind on payments, the lender could foreclose on his interest in the property. They could then probably force a sale of the property in an action for partition. To prevent this, one option would be to pay off or assume the loan and buy out your brother's interest in the real estate. Since he is behind on his loan, you could probably drive a pretty hard bargain. If you do nothing, the lender could eventually take your brother's interest in the property and force a sale.

What's permitted alterations in a commercial lease?
I am a small business owner looking to rent a commercial space for the first time. I am considering signing a commercial lease and want to know what kind of alterations are allowed in the agreement. I would like to avoid any potential legal issues or disputes in the future by clarifying what is permitted before signing the lease.

Usually permitted alterations are cosmetic, and non-structural in nature. Often times the Landlord will require the Tenant to submit plans, or in the alternative the lease will describe the fit and finish that would be allowed.

What's the parking situation in a commercial lease?
I am currently in the process of signing a commercial lease for a retail store and I need to know the parking situation that is included in the lease. I have read through the lease and I'm not sure if the parking is included or if I have to arrange it myself. Can a release of lien be obtained without paying off the underlying debt?
I purchased a property that had an existing lien on it, and the seller promised to obtain a release of lien before the closing, but now they are refusing to do so unless I pay off the remaining debt, even though the lien was filed against them, not me - I want to know if it is possible to obtain a release of lien without having to pay off the underlying debt.

The standard practice is that any lien against the property should be paid off at or before closing. You should also have obtained title insurance, which generally covers liens that were not satisfied. You should have received a copy of your title insurance policy sometime after closing, and the lien coverage (or any exception) should appear on the policy. At this point, you should contact an attorney to review all of your closing documents and advise you on the best course of action.
