I am trying to execute a purchase and sale agreement with a seller or their real estate agent who live in California.

The short answer is you can be an out of state purchaser but you need to right support team behind you. Signing the contract can be done electronically and you don’t need to be in California to do that. Either a real estate attorney or hiring your own agent.

If your Texas home sold for more than what you owed, you may be entitled to what is called surplus or excess funds. These funds are held by the county or trustee after foreclosure. To claim them, you must file a petition for release of surplus funds with proof of ownership and sale details. What are the rights and responsibilities of a tenant in a triple net lease?

As a small business owner, I am considering entering into a triple net lease agreement for a commercial property. I have heard that in a triple net lease, the tenant is responsible for paying not only the rent but also additional expenses such as property taxes, insurance, and maintenance costs. Before signing any agreement, I would like to understand the specific rights and responsibilities I would have as a tenant in a triple net lease, and how these differ from a standard lease agreement.

Hello there! Yes, typically a triple-net ("NNN") lease pushes all of the property (or portion thereof) expenses onto the tenant - essentially as if the tenant was the owner. This differs from a gross lease, where a tenant pays rent only (therefore, the tenant can more accurately predict annual costs). In a NNN lease, it is important for a tenant to (at minimum) be able to estimate how much the NNN expenses will be prior to executing the lease. If a NNN lease is the only option, there are many ways the lease can be revised to mitigate risk for the tenant. I’d be happy to review the lease and suggest such revisions. Thank you!

The exact situation is unclear as Subordination is usually when you are selling rather than buying. Subordination means putting something in a lower priority compared to something else. In legal and financial terms, it usually comes up when talking about loans or claims. When one party agrees to “subordinate” their claim, they’re saying: “I’ll wait in line — you get paid before I do.” There must be multiple loans or claims and bank is establishing the order they'll get paid.
