Settlement Agreement

Florida

Asked on Dec 18, 2023

Are settlement agreements common in business?

I am a small business owner considering entering into a business partnership with another individual. We have discussed the possibility of a settlement agreement to define our respective rights and responsibilities in the partnership. I am interested in knowing if settlement agreements are common in business, and how they are typically used in such agreements.

Answered Dec 19, 2023

Their called Operation Agreements, and every partnership and LLC should have one. Most do.

Debt Settlement Agreement

Florida

Asked on Jul 12, 2023

Debt settlement agreement due diligence?

I recently entered into a debt settlement agreement with a company and I am concerned about the due diligence that was conducted by the company. I am worried that I may have been taken advantage of and I would like to know if the agreement is legally binding. I would also like to know what options I have if the agreement turns out to be invalid.

Diane D.

Answered Jul 28, 2023

The only way to tell if your agreement is legally binding and what options you have is to have an attorney review it. However, if all the parties have signed the agreement, it is most likely legal.

Employee Separation Agreement

Florida

Asked on Jul 19, 2023

Employee separation agreement and unemployment benefits?

I recently resigned from my job and my employer is asking me to sign a separation agreement. I am concerned that if I sign this agreement, I may not be able to collect unemployment benefits. I need to know if signing this agreement will affect my ability to receive unemployment benefits.

Diane D.

Answered Jul 28, 2023

The only way to answer your question is to have an attorney review the agreement. Not sure why it would stop you from collecting unemployment benefits, but, again, without seeing the agreement, there is no way to answer this question.

SaaS agreement and support services?

I am a software developer who is in the process of developing a new software as a service (SaaS) model. I am looking for guidance on the legal implications of the agreement between myself and my potential customers. Specifically, I am looking for legal advice on the best way to structure the SaaS agreement, as well as the types of support services that should be included in the agreement.

Terms and Conditions

Florida

Asked on Nov 30, 2023

Are vague terms and conditions valid?

I recently signed a contract with a company that included terms and conditions. Many of the terms were vague and I'm concerned that they may not be valid. I'm worried that this could put me in a vulnerable position and I want to make sure that I understand my rights and obligations before proceeding.

Diane D.

Answered Dec 12, 2023

Yes, vague terms and conditions are valid. If you would like for me to review the contract for you before you sign to let you know what you will be or not be liable for, please contact me at ddowns@dmdlawpa.com
