Hello! The most significant risk is missing or being late on a payment, which could potentially breach the purchase agreement. Another risk is that the current owner usurps the deal or attempts to sell the property to someone else. At least, these are some of the practical risks. An attorney should review the written Lease Purchase agreement to outline the potential risks and recommend possible edits.

Can a coaching agreement be terminated if the coach fails to meet the agreed-upon objectives?
I entered into a coaching agreement with a professional coach to help me improve my business skills and achieve specific objectives within a certain timeframe. However, after several sessions, it is becoming apparent that the coach is not adequately addressing my needs and failing to help me make progress towards my goals. Can I terminate the coaching agreement and seek a refund or another coach who can better meet my needs?

In this situation, both parties agreeing to terminate the contract is best because of your dissatisfaction. The coach's failure to provide adequate advice could be difficult to prove. Conversely, the coach would have to prove they provided adequate services. So, a mutual agreement to terminate the agreement is preferable. You could attempt to negotiate a partial reimbursement.

I am currently in a ground lease agreement where I am the lessee, and I recently received a notice from the lessor stating that they intend to terminate the lease due to a violation of a non-monetary covenant. The specific covenant in question pertains to the maintenance and upkeep of the property. I have been diligently maintaining the property, but there may have been some minor lapses in the past. I would like to know if the lessor has the legal right to terminate the ground lease early based on a non-monetary covenant violation, and what options I have to defend against this termination.

Hello: The success of a claim of breach of the agreement depends on whether the alleged violation of the specific non-monetary covenant is material and whether there is a right to cure it. If it is a minor or curable breach, and the lessee can cure it, then the lessee may have defenses to an alleged breach claim.
