Rent agreement/lease

Hello, I signed a lease for a commercial rental. The owner said that the previous tenant was there for over 20 years and he needed to fix the place. We signed the lease and gave him the deposit, he said that upon completion of the build out he was going to hand us the keys. I needed to buy doors and the handles. I gave him $1500. He said that he would safe the receipts. The build out is completed and he gives me a bill of 5k for things that he "had" to do. He said that the vents were too old, that he had to change the heater and other stuff. When I said no because I was not expecting to pay anything, he sends me a new bill for 12k because I was being unappreciated of the work he did. I need to know my options since I don't have the keys yet and I won't pay something that I didn't know it was needed. Thank you!

It depends on if there was a written agreement or a verbal agreement for your options. Sending a demand letter from an attorney followed by negotiations could help resolve the problem and avoid litigation. What is the best type of commercial lease?

I am a landlord and am wanting to consider which types of commercial lease agreements I would want to use. I own a small strip mall and am looking to sign tenants that would be retailers.

Much of that depends on the tenant and the agreement they are willing to enter into. Personally, I would want my tenants responsible for as much of the maintenance and upkeep of the property as possible. The same goes with the property taxes. You could calculate out what property taxes are / would be per square foot and allocate to them which will permit you to adjust rent annually to accomodate changes in the property taxes.

I am looking to understand the legal implications of assigning the lease, as well as any other requirements or restrictions I should be aware of.

In Massachusetts, a commercial tenant can assign or sublet the unit to a third party - UNLESS there is a specific prohibition in the current lease. However, even if there is such a prohibition, it might still be worth speaking to the landlord about since it might be mutually beneficial.

Can a landlord terminate an office space lease before the agreed-upon term ends?

I recently signed a lease agreement for office space for my small business, but due to unforeseen circumstances, I may need to relocate sooner than anticipated. I want to know if the landlord has the right to terminate the lease before the agreed-upon term ends, and if so, what are the potential consequences for me as the tenant? I am concerned about any financial penalties or obligations that may arise from terminating the lease early.

A landlord could agree to terminate the lease if a tenant requests it or can modify a lease to allow for an option for a tenant to vacate the premises at an earlier date. If a tenant wants to vacate the premises on an earlier date than the lease end date, either the landlord would have to agree to the earlier termination date or the tenant could be found in breach of contract. If you are considering early termination, it's advisable to communicate with the landlord to explore possible solutions, such as subleasing, assigning the lease, or negotiating a modification to the lease agreement. In North Carolina, commercial rent is commonly calculated as a set dollar amount per square foot. This dollar amount is usually based on factors like location, age, condition, accessibility, and amenities. However, there is no requirement for rent to be determined this way. Unlike a residential lease agreement, the terms of a commercial lease agreement can be almost anything that the parties mutually agree to. As a word of caution, in North Carolina, commercial tenants do not have the same degree of legal protections as residential tenants. For just one example, a tenant who wishes to terminate a commercial lease early may be responsible for the entire remainder of the rent unless the lease agreement says otherwise.
